Terms and Conditions of Use (“Terms of Use”)

GENERAL

This page tells you the terms and conditions of use (“Terms of Use”) on which you may make use of Nadi.BN website (“Site”) whether as a guest or a registered user. The Site include by using the Site, the mobile application (“Application”), and downloading, installing or using any associated software supplied. This Site is owned and operated by the Authority for Info-communications Technology Industry of Brunei Darussalam (“AITI”).

Please read the Terms of Use carefully before you expressly agreed and abide by them, and other applicable rules and policies available. By using the Site, you agree that you have read, understood, accepted and agreed with the Terms of Use. If you do not agree to the Terms of Use, please refrain from using the Site.

The Terms of Use constitutes a legal agreement between you and AITI. By using the Site, you hereby expressly acknowledge and agree to be bound by the Terms of Use.

 

END USER

 Using and accessing the Site by a person (“End User”) does not require an account, unless the accounted is registered by submitting the personal data of a person (“Registered End User”).

 The account is solely for the Registered End User’s own personal and non-commercial purposes. The is valuable, and it is the responsibility of the Registered End User for maintaining its confidentiality and security. This includes, but not limited to, safeguarding and maintaining the confidentiality of the account and not to share the registered email address or the password.

AITI is not responsible for any losses arising from the unauthorised use of the Registered End User’s account.

 The Registered End User may contact if the End User has any complaint or concern relating to the Site.

 The Registered End User may cancel their access and/or account to the Site by contacting AITI Customer Service Unit. And understand that by doing so, AITI does not have the obligation to keep, delete or return the Registered End User’s submitted content or materials and/or provide the Registered End User with any form of report.

 For the avoidance of doubt, the termination of the Registered End User account shall not require AITI to compensate, reimburse or cover any cost incurred in the course of using the Site.

 

API

 AITI may offer collections of data, managed by AITI and provided in a number of machine-readeable formats (“Datasets”) through an Application Programming Interface (“API”). The End User can use, access, call, command, query or request the API, whether commercially or non-commercially.

This does not grant the End User any rights over any personal data should any personal data be included or exposed through the APIs, inadvertently or otherwise; and any intellectual property found in content accessible through the APIs.

 The End User agrees that AITI may monitor the usage of the API to improve the service, track usage, to ensure compliance with these Terms of Service, or for security purposes. When use the API, it must be utilised the access control credentials issued to the End User if applicable. The End User agrees to keep such credentials secure and confidential. The End User shall not mispresent or mask its API Client’s identity when using the API.

 The End User shall warrant that its API Client(s) are free of any Unauthorised Code and shall not exploit any vulnerability of the API or servers, inject any unauthorised or malicious scripts, codes, commands, queries or requests, or introduce any Unauthorised Code through the API.

 

LICENCES

 The End User is encouraged to use the Datasets to benefit themselves and others in creative ways. It may be allowed to extract, download, and make copies of the data contained in the Datasets, and may share that data with third parties according to these Terms of Use.

 The Datasets that listed its author as the Government of Brunei Darussalam are provided to the End User subject to the agreement with the Data Policy: https://www.data.gov.bn/SiteCollectionDocuments/Data%20Policy.pdf

For other Datasets, unless specifically labeled otherwise, these Datasets are provided to you under a Creative Commons Attribution 4.0 International Licence (CC BY 4.0).

 

Intellectual Property Rights

 All contents contained, including, but not limited to, text, graphics, logo, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of AITI, or any other relevant third parties. By continuing this Site, the End User acknowledges that such contents is protected by the laws of Brunei Darussalam and any other applicable international intellectual property legislation.

 In the event of such allegation of infringement of copyright, trademark, patent or other intellectual property rights by any third party, or if in the opinion of the End User such a claim is likely to be made, the End User shall at its own cost and expense, obtain for AITI the right to continue use or arrange for a suitable replacement (without detracting from the requirements specified by AITI in this Terms of Use) so as to avoid infringement.

 The use of the name, trade name, logo, trade mark and/or official emblem of either of the Parties on any publications, document and/or paper is prohibited without the prior written approval.

 

AVAILABILITY OF THE SITE

 The Site is provided “as is” and on an “as available” basis. AITI provides no warranties of any kind and hereby disclaims any warranty, whether express or implied, as to the accuracy, correctness, reliability, currentness, validity, timeliness, non-infrignment, title or functionality for any particular purpose of the Site. This shall include any functions and contents associated with a third party.

 

LIMITATION OF LIABILITY

 To the maximum extent permitted by law, AITI shall not be liable for any direct or indirect loss, errors or omissions arising from the use of the Site or any information containted therein.

 The End User expressly agrees that the use of, or inability to use, or activity in connection with the Site is at their sole risk.

 

INDEMNITY

 The End User agree to indemnify AITI and hold AITI against any and all losses, liabilities, costs, claims and expenses that AITI might suffer as a result of breach of this Terms of Use.

 

VIOLATION

 By continuing to use the Site, the End User may only use for authorised means. The End User further agree that it is the responsibility of the End User to ensure not to use for purposes that may contravene the rights or restrict the use and benefit of its contents and services, including:

  • Violate the law.
  • The use of unauthorised data or access to system and network.
  • The use of virus or any similar that can disrupt service to any user.
  • Exploiting any personal data.
  • Providing the contents and services for profit or otherwise.

The End User further agree that it is the responsibility of the End User to ensure not to use for purposes that may contravene the rights or restrict the use and benefit of its contents and services, including:

  • Violation of the Terms of Use, and other applicable rules and policies available.
  • The use of unauthorised data or access to system and network.
  • Interuption of the operation of the Site or any portion of the Site, as necessary to perform scheduled or non-scheduled maintenance, error connection, or any other changes.
  • Exploiting any personal data.
  • Providing the contents and services for profit or otherwise.

AITI reserves the right to seek all remedies or injunctive relief available under the law and in equity for such violations as it deems necessary or appropriate in such circumstances.

AITI may disclose any information on the End User (including the identity) if determine that such disclosure is necessary in connection with any investigation or complaint regarding the use of the Site, or to bring legal action.

 

Modification

AITI reserves the right to modify from or vary its position of the Terms of Use at any time without prior notice

AITI also reserves the right to modify, alter, suspend or discontinue the Site at any time, including with or without notice, and shall not be liable to the End User or to any third party that exercise with any rights.

If any conditions shall be limited, narrowed, construed or altered, void or invalid, the Terms of Use shall be deemed severable and not affecting the validity of the remaining conditions which will remain in full force and effect.

 

INTERRUPTION

While AITI makes every effort to ensure the Site work and functions as intended, the Site maybe be subject to limitations, delays and other disruption inherent in the use of the Site.

AITI provides no warranty, assurance, or promise that the Site will work as intended and AITI shall not be responsible for temporary interruptions due to technical issues beyond its control.

 

PRIVACY POLICY

The use of the Site is also governed by our Privacy Policy which is incorporated into the Terms of Use.

 

LINK TO OTHER SITES

The Site may contain links to other Sites (“Linked Sites”) which are provided solely as a convenience to our End Users. End User agrees that accessing these Linked Sites are under the responsibility of theEnd User. Such Linked Sites are not under AITI’s control and AITI will not be responsible for and any endorsement on the content.

AITI is not responsible for examining or evaluating the content or accuracy of any third-party external services, and shall not be liable for any such third-party external services nor all forms of damages or losses that End User may occur as a result of entering the Linked Sites.

 

NOTICE

AITI may give notice by means of a general notice on the Site.

 

FEEDBACK

Any feedback the End User provide shall be deemed to be non-confidential. AITI shall be entitled to use such information on an unrestricted basis.

 

GOVERNING LAW

The Terms of Use is governed by and is to be construed according to the laws of Brunei Darussalam and agree to submit to the exclusive jurisdiction of the Courts of Brunei Darussalam.
